Plain-English Summary: Use Orpheus Leads for your own legitimate real estate business. Don’t harass property owners, resell our data, or use the platform to build a competing product. TCPA compliance is entirely your responsibility.
1. Purpose
This Acceptable Use Policy (“AUP”) defines the permitted and prohibited uses of the Orpheus Leads platform (“Service”). This AUP is incorporated into and forms part of the Terms of Service. Violation of this AUP may result in immediate account suspension or termination without refund.
2. Permitted Use
You may use the Service solely for:
- Identifying and researching real estate leads for your own licensed real estate practice
- Managing your personal lead pipeline and follow-up schedule
- Generating and reviewing AI-drafted outreach scripts and emails for your own use
- Analyzing market activity in your target geographic markets
- Accessing property owner contact information solely for the purpose of legitimate real estate outreach
3. Prohibited Use
3.1 Illegal and Harmful Conduct
You may not use the Service to:
- Contact property owners in a harassing, threatening, abusive, or deceptive manner
- Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any applicable do-not-call or anti-spam laws
- Contact individuals on federal or state Do-Not-Call registries without a valid exemption
- Impersonate another person, agent, or business entity
- Engage in any fraudulent, deceptive, or misleading communications
- Violate any applicable real estate licensing law, professional code of ethics, or MLS rules
3.2 Data Misuse
You may not:
- Reproduce, redistribute, resell, sublicense, or transfer lead data, skip trace data, or AI-generated content to any third party
- Use Service data to build, train, supplement, or operate any competing real estate lead generation product or service
- Export, scrape, or systematically extract data from the Service beyond normal use
- Use contact information obtained through the Service for any purpose other than direct real estate outreach
- Aggregate or combine Service data with other data sources to build a resaleable database
3.3 Platform Integrity
You may not:
- Share your account credentials or allow use of your account by individuals not authorized under your subscription plan
- Use automated bots, scripts, or tools to access the Service beyond normal interactive use
- Attempt to circumvent any security, access control, or rate limiting measures
- Interfere with or disrupt the Service or its infrastructure
- Attempt to reverse-engineer, decompile, or extract source code from any component of the Service
3.4 TCPA and Telemarketing — Specific Notice
The Telephone Consumer Protection Act (TCPA) and related FCC regulations place significant restrictions on telephone solicitation, including live calls, automated calls (robocalls), and text messages to both mobile and residential numbers. Violations carry statutory damages of $500–$1,500 per call or text, and class actions are common.
When using Orpheus Leads data and scripts to contact property owners, you must independently ensure:
- You have a permissible purpose and, where required, prior express written consent
- You have scrubbed numbers against the National Do Not Call Registry and applicable state lists
- Your calling practices comply with all applicable time-of-day restrictions
- You honor opt-out and do-not-contact requests immediately
- Any use of an auto-dialer or pre-recorded message complies with TCPA requirements
Orpheus Leads does not audit your outreach practices and accepts no liability for TCPA violations.
4. Enforcement
We reserve the right to investigate suspected violations of this AUP. Upon finding a violation, we may:
- Issue a warning
- Temporarily suspend your account
- Permanently terminate your account without refund
- Report the conduct to law enforcement or regulatory authorities where required
We are not obligated to monitor your use of the Service, but we may do so to ensure platform integrity.
